Many homeowners with low mortgage rates feel financially locked into their current property. H.R. 10028 proposes a significant change: allow certain borrowers to transfer the rate, terms and remaining balance of a conventional mortgage to a replacement property.

The Making Ownership Viable for Everyone Act, or MOVE Act, was introduced in the House on August 3, 2026 and referred to the Financial Services Committee. The two-page bill text would require Fannie Mae and Freddie Mac, within 180 days after enactment, to begin purchasing and securitizing qualifying conventional mortgages that allow the borrower to transfer the interest rate, terms and balance to a new property within 90 days after selling the original one.

The bill is not law. It has not passed the House or Senate, and no portable-mortgage program exists under it today. It does not say that every existing mortgage would become portable. It addresses conventional mortgages eligible for Fannie Mae or Freddie Mac purchase and securitization, not FHA, VA or DSCR loans generally.
Important implementation questions would still need answers: how the replacement property is underwritten, how a higher purchase price is financed, how liens and collateral transfer, how closing timing works and what happens when the borrower’s financial position changes.
If a workable version became law, portability could reduce the rate-lock barrier keeping some owners from listing. That could increase move-up and downsizing inventory, including waterfront and beachside properties. It could also create buyers who can preserve an older rate on part of a new purchase.
That is informed interpretation, not a forecast. Sellers should not delay or structure a transaction around the proposal today.
For a current waterfront example, 300 Columbia Drive #3204 in Cape Canaveral competes for buyers whose decisions are shaped by the total monthly cost, including rate, HOA dues, insurance and taxes. Portability would matter because it could change that monthly-cost equation, if the proposal ever becomes an operating program.
Watch the bill, but make current listing decisions using current financing. A seller’s best tools remain correct pricing, verified property and association facts, strong presentation and a lender-aware strategy.
